Associate Professor Ben Chen

Ben Chen is a law and economics scholar writing in the areas of equity and trusts, succession law, civil procedure, and game theory. His publications include full-length original articles in American Law and Economics Review, Cornell Law Review, Economic Theory, Melbourne University Law Review (on parens patriae, class actions), and Modern Law Review. His sole-authored, practitioner-oriented articles have been cited extra-judicially by judges of the New South Wales and Queensland Courts of Appeal. The Australian Research Council has awarded him a Discovery Early Career Researcher Award (DECRA) and a Discovery Project (DP) grant.

Ben is currently researching on inheritance litigation and superannation as inheritance. His cognate economics research develops contest theory and information design theory to better incorporate bounded rationality, other-regarding preferences and externalities. His doctrinal research explores how equitable principles interact with succession law and conflict of laws.

Shortly after joining the Law School in 2018, Ben almost concurrently completed a JSD at Columbia Law School (in 2019) and a PhD in economics at the Australian National University (in 2018). In his final year of undergraduate studies, he served as Tipstaff to Justice Geoff Lindsay AM of the NSW Supreme Court (in 2012-13). During his postgraduate studies, he worked as a judge’s associate at the ACT Supreme Court (in 2013-14) and a sessional academic at the Australian National University (in 2014-16). While at Columbia (in 2015-18), he worked as a research assistant for Professor Elizabeth S Scott, the chief reporter for Restatement of Children and the Law.

Ben serves on the editorial board of Sydney Law Review and the board of counsellors of the Francis Forbes Society for Australian Legal History. He is a Fellow of the Higher Education Academy (FHEA).
